TERMS AND CONDITIONS
TDS applies to all GBSS clients TDS applies automatically to all GBSS clients on services subscription, including services subscription at commercial third party or partners. SUBSCRIBING ON GBSS SERVICES, YOU ACCEPT AND COMPLY WITH THE POLICY YOU HAVE BEEN NOTIFIED ON THIS DOCUMENT. Service order is described as a package and presented on the website. In this document, GBSS hosting areas applies to the subscribers on hosting packages.
GBSS agrees to provide services described in the Order of Service signed by the parties. Using GBSS services constitutes acceptance and agreement with the terms of Service. GBSS will make every reasonable effort to provide quality customer service.
GBSS will only use the personal information of customers to provide services under the contract and collect fees owed and will not disclose such information to any third party except if required by law or collection services. Client authorizes GBSS to use the name, trade name and comments in marketing documents. At any time, the client may send a written notice of withdrawal of such authorizations.
Any IP addresses assigned to the GBSS client must be maintained in an efficient manner as RIPE rules and used at 80% within 30 days after the award. Failure to comply may result in revocation of sections of this IP address by GBSS after five days of notification of the client. GBSS maintain ownership and control of all Internet Protocol numbers and addresses (IP) that can be attributed to customers, and reserves the right to modify or remove any such numbers and addresses.
Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists”, purchased lists, and selling of lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
On demand, GBSS may provide Customer technical support and non-technical support, such as equipment troubleshooting, DNS and other types of support, using the customer space to interact. Customer physical access to the equipment is strictly prohibited. GBSS is the owner of the equipment used by the customer which pays a license to use this equipment.
If GBSS reasonably appreciates, that equipment, software or hosted applications used by the client or the client’s activities represent an immediate threat to the physical integrity of the spaces or physical integrity of network equipment performance or any other user space, or represent an immediate threat to the security of a person, then GBSS will carry out necessary activities to avoid imminent danger, without the prior written acknowledgment of the customer and without liability for damage to equipment or data for any interruption of the Customer (or its customers’) business. As soon as actions are carried out, GBSS will inform, by e-mail the client about take measures.
Subscriber will send in advance with 30 days, an email application for equipment relocation, server or web site to another space offered before by GBSS .
In no case GBSS will be required to provide insurance coverage for any equipment or data held by the client and housed inside the GBSS.
If the customer is indebted to GBSS, according to the signed agreement, GBSS may do the following whith minimum notification:
(i) without notice suspend the client’s access to space
(ii) sell third-party equipment in pursuit of compensation.
USER MAY NOT:
Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
Run any software that interfaces with an IRC (Internet Relay Chat) network.
Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
Participate in any file-sharing/peer-to-peer activities
Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
Run cron entries with intervals of less than 15 minutes.
Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.
When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use include(“include.php”).
To help reduce usage, do not force html to handle server-side code (like php and shtml).
Only use https protocol when necessary; encrypting and decrypting communications is noticeably more CPU-intensive than unencrypted communications.
The service will be discontinued for failure to pay within 24 hours after notification.
Before the end of initial agreement, 30 days or more, GBSS may change the fees payable under current agreement, and send a written notice to the customer.
Downgrade and upgrade services
Downgrade service will come into force on the account anniversary date (anniversary date account corresponds to the day of the month in which an account was opened. For example, if an account was opened on May 5, this account can be changed on the 5th of every month once the initial commitment is over). Service upgrades, however, may come into force at any time.
On client account activation, on space, equipment and resources reservation. Customer must pay for his account, even if he is not using it.

2. Security policy

Guaranteed electricity GBSS guarantee the electricity supply to 99 % for all data center customers who subscribe to a solution that includes a portable power or an amp circuit. Guaranteed replacement parts At any time, the hard drive not functioning on the dedicated server will be replaced within 8 hours.
Neither party shall be responsible for any delay, interruption or failure in meeting its obligations if caused by acts of God, war, declared or undeclared, fire, flood, storm, earthquake, or other such events beyond the control affected parties (force majeure). If any Force Majeure occurs, the affected part will promptly notify the other. Part of Force Majeure, shall use commercially reasonable efforts to sustain elimination or remedy the Force Majeure. This section shall not apply as an excuse for failure to make payments to GBSS.
GBSS Shared Hosting.GBSS will make every effort to provide a backup mechanism and keep complete backup copies of all shared web hosting. However, client must keep a backup copy of software, website, database and all content hosted. GBSS should not be held responsible for any data loss or data corruption.
Customer is the only responsible for the content stored on its servers and published on the Internet.
This Agreement including the attachments hereto and any Services signed by the parties constitute the entire agreement between the parties regarding the subject matter hereof and supersede all proposals and prior discussions and writings between the parties with respect thereto. EXCEPT AS SPECIFICALLY PROVIDED IN THIS AGREEMENT, GBSS MAKES NO REPRESENTATION, WARRANTY OR CONDITION, EXPRESS OR IMPLIED, AND EXPRESSLY EXCLUDES ALL IMPLIED OR STATUTORY WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, DURABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR TITLE OR NON-INFRINGEMENT AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. In case of any dispute or inconsistency this main agreement,any attachments, and/or any Service Order, the Service Order will take first priority, this main agreement will take second priority and the attachment will take third priority in interpreting the parties’ rights and obligations.
Severability and Reformation
If any part of this agreement is determined to be or becomes unenforceable or illegal, shall be reformed to the minimum extent necessary so that this Agreement shall remain in force in accordance with what has been changed by such reforms.
A “Cancellation” occurs when the Customer or Supplier voids an order for a withdrawal of funds from a Customer’s Card account or bank account before a sale is sent for deposit.GBSS will not collect a deposit from the Customer and the previously authorized funds will be released at the Card issuing bank’s discretion. After a sale is sent for deposit, any attempt to reimburse the cost of a Product to a Customer constitutes a Refund and shall be dealt with as set forth below. You may contact us regarding your purchase from GBSS within 15 days of delivery for a full refund. No refund for software solutions sold by GBSS.
A refund is the actual reimbursement of the cost of a Product to a Customer(“Refund”).GBSS accomplishes the Refund by reversing the amount previously charged to the Customer’s Card or account at the Card issuing bank and the appropriate amount is credited to the appropriate Card or account at the Card issuing bank of Customer. A client may benefit of only one refund of one product per month. All refunds will be issued within 30 days of the end of your normal billing cycle. No refund for software solutions sold by GBSS.
If you want to cancel a service after activation need to pay a fee (management fee and activation) of $ 50 for web hosting packages and payment service bought from the activation date to service cancellation date at full price . If you want to cancel the web hosting package , it remains active until it makes a full month from the date of activation . There are no refunds on VPS servers , VDS servers , Dedicated servers, Domain names, Administrative fees, and Install fees for custom software.No refund for software solutions sold by GBSS.
After 15 days no amount can not be refunded because it means that the client was satisfied with the quality of service .
GBSS reserves the right to add, delete, or modify any provision of this Policy at any time without notice.
Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, canceled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.
Violations of the Terms of Service will waive the refund policy.
Choice of Law and Attornment
This Agreement shall be interpreted in all respects, in accordance with the legislation.
Complaints or TDS violations should be reported to us
Changes and Rights
GBSS may vary these rules and regulations from time to time in its sole discretion, sending a notification in 10 days advance, and Customer will comply with all security requirements imposed by GBSS.
